The present privacy policy is in accordance with article 13 of the European Regulation no. 679/2016 (hereinafter “GDPR”), and with Legislative Decree no. 196/2003, as integrated by the Legislative Decree 101/2018. According to this regulation, such treatment will respect the principals of fairness, legality and transparency and protection of your privacy and your rights. According to the aforementioned articles, please note the following information:

  1. The Data Controller is Azienda Agricola Vannucci Piante di Vannucci Vannino (hereafter, Data Controller), with registered office in Pistoia (PT), via Pratese, 238; local units: Quarrata (PT), loc.   2. Your personal data will be treated according to the following purposes:

 

  • Direct marketing. Your personal data provided by you are treated only after your express consent (art.7 GDPR), for the following marketing purpose:

 

  • reception of commercial and/or promotional communications, catalogues, and invitations to events through email, phone calls, sms, Whatsapp.

The legal basis of the treatment is therefore your freely given, specific, informed and unambiguous consent given by ticking the appropriate box.

 

  • Customer Profiling. It is possible to collect and use relevant and adequate data for groups or individual’s profiling. It is necessary for the interested party to obtain an optional, separate, specific and informed consent. The profiling activity may concern “individual” personal data or “aggregated” personal data deriving from detailed individual personal data. Such treatment could use personal data which can be aggregated according to parameters defined by the business’ needs. The data could include varied personal information, such as data of contractual nature and on existing consumer relationships and buying habits, etc. from which it is possible to deduce further indications that can be attributed to each individual (for example, the market segment, regular buying habits, etc.).

 

The legal basis of the treatment according to article 6, GDPR, in relation to the aforementioned purpose lies in the consent for customer profiling.

  1. It is optional to provide data for the Data Controller’s marketing purposes and the refusal entails the impossibility to receive commercial and/or promotional communications from the Data Controller. The refusal to consent for profiling purposes will prevent the Data Controller to proceed with the aforementioned profiling.
  2. The addressees of the treatment are those responsible for it (along with third parties data controllers) and individuals which are part of the Data Controller’s organization and are authorized by him. Personal data will not be object of diffusion, but they may be disclosed to third parties, exclusively for technical and operative reasons strictly linked to the aforementioned purposes. In particular, to software companies and to automated email marketing systems.
  3. The data are treated and collected in the registered office and the local units of the Data Collector and are stored on servers located in his and in the European Union Headquarters. However, the Data Collector can use the instant messaging app Whatsapp Inc., headquartered in the United States, for purposes of direct marketing and profiling. In any case, Whatsapp Inc. has joined the EU-US Privacy Shield Framework with the U.S. Department of Commerce with regard to the collection and processing of personal data in the European Union. The Data Collector uses also MailChimp’s email marketing service, headquartered in the United States, which participated and has certified its compliance to the GPR joining the EU-U.S. Privacy Shield Framework.   4. The treatment of your data for purposes of direct marketing and customer’s profiling is valid until the user’s unsubscription, which is possible through the link present in every email. In case of a less frequent transmission frequency, all users will receive a check communication with the unsubscription link at least every twelve months.
  5. You have the right at any moment to: access your personal data; to request its correction or cancellation or you may request limitation of processing and may object to processing; you will also have the right to data portability and if you wish to make a complaint you can also submit it to the personal data protection Authority. You may exercise your rights by sending an email to gdpr@vannuccipiante.it.
